EZ PADS, INC. - Policies, Terms and Conditions

Security and Privacy Policy
We protect you by utilizing secure on-line credit card transaction technology. We also protect your privacy and never give out your personal information without your consent. Any information we collect about you is used to make recommendations and process orders only.

Payment Terms
We accept Credit Card and Personal Check payments through PayPal. (The safest way to order online). All orders are prepaid. Your credit card statement will show PayPal as the payee unless order is placed by phone or fax.

Note: Once a package has shipped the order cannot be cancelled. Fed Ex is unable to stop the order in mid-shipment. The shipment will be delivered. You can either refuse shipment at the time of delivery or contact us to arrange for the return of the cancelled shipment. Every returned EZ Pad is carefully inspected to ensure it has not been assembled. ISO 9000 standards require only unassembled product may be shipped as new. If it is determined by our quality assurance inspectors that the EZ Pad has been assembled, no refund will be issued. No partial returns are accepted.

Please Note: Whether a cancellation and / or a return, customers are responsible for shipping costs and restocking fees. These costs include: Fed Ex call tags, insurance, shipping charges, PayPal processing fee and restocking fee.
In order to qualify to return your EZ Pad. . . All items be must be in the original packaging as shipped and in re-sellable condition. If the EZPad or pads have been assembled and connectors screwed in then disassembled it is not considered new and in re-sellable condition.

If you meet the requirements to have the EZ Pad returned and it is within 30 days of your delivery then contact us at: admin@ezpads.com with your Name, Address, Daytime phone and reason for the return. We will contact you and issue a product return authorization.

We will not accept any returns after 30 days.

If you are concerned about placing your order online, you may place your order over the phone, toll free at 1-866-397-2370 during business hours: Monday through Friday from 9 am to 4pm PST; or by FAX anytime at 1-866-397-7200.

Freight Damaged Product
In case of receipt of damaged shipment, refuse shipment and notify us within 24 hours so that we may follow up. Be sure to inspect your EZ Pad when it arrives. If you are not present at delivery, and see any damage, please photograph both damage to EZ Pad panels and packaging and email to admin@ezpads.com. This allows us to provide the proper response. Damage returns MUST be in original packaging for refund/replacement.

Refused Shipment
For reasons other than freight damage, customer is responsible for all shipping charges and a restocking fee on any unclaimed or refused shipment.

Shipping/Handling Policy:
EZ Pads are shipped only to the 48 contiguous states. No orders will be shipped to Alaska or Hawaii. All orders will be confirmed and shipped by the end of next business day. Our product is shipped direct from our factory in Kansas via FedEx Ground, and delivery generally takes from three to seven business days, depending on your location. We will provide you with a tracking number, so you may contact Fed Ex at 1-800-GOFEDEX, or track your package on their website. We do not ship to a PO Box address.

Warranty Information/ Lifetime Guarantee
Any EZ PAD found by the manufacturer to be unserviceable due to defects in materials or workmanship will be replaced. The EZ Pad is guaranteed not to crack, chip, blister or peel for the life of the product.

This warranty extends only to the original consumer purchaser and their initial hot tub installation of the EZ PAD and terminates upon any transfer of ownership by the original consumer purchaser. Except as expressly provided, there shall be no additional warranty, obligation, expressed or implied, oral or statutory.

This warranty does not include damage incurred by use of the EZ PAD other than in accordance with printed instructions or product literature provided by EZ Pads, or conditions resulting from:

  • Defects in component or part, which is not part of the EZ PAD.
  • Failure to provide reasonable maintenance and/or improper installation.
  • Fading due to ultra violet (UV) exposure.
  • Misuses, abuse, negligence, accident, acts of God, or alterations/repairs other than authorized by EZ Pads.

Rights and Remedies

  • EZ Pads shall not be liable for consequential damages or any incidental expenses resulting from any breach of the above expressed warranties.

  • This warranty gives you specific legal rights, and you may have other rights, which vary from state to state.

  • Any dispute between the buyer and EZ Pads pertaining to this warranty may, at the option of the buyer, be resolved in California according to the rules of the American Arbitration Association.

Neither party will be liable for any delay, interruption or failure in the performance of its obligations if caused by acts of God, war, declared or undeclared, fire, flood, storm, slide, earthquake, or other similar event beyond the control of the party affected ("Force Majeure"). If any Force Majeure occurs, the party claiming the Force Majeure will promptly notify the other. The party claiming the Force Majeure will use commercially reasonable efforts to eliminate or remedy the Force Majeure. This Section will not apply to excuse a failure to make any payment when due. In addition, the Client agrees to indemnify EZ Pads Inc. against any loss resulting from third party actions which are out of the control of EZ Pads Inc.. This includes, but is not limited to, actions by manufacturers, shipping companies or other third parties.

Third Parties/Dealers
EZ Pads does not offer remedies for issues with third parties or dealers regarding shipping, delivery, or availability.

Policy Changes
These policies and conditions are subject to change without notification, and may be changed at any time.
